GAMETIME NUTRITION LLC
REMOTE NUTRITION COACHING AGREEMENT
This Remote Nutrition Coaching Waiver and Agreement (“Agreement”) is entered into by and between GameTime Nutrition LLC (“GameTime Nutrition” or “Company”) and the undersigned client and/or parent or legal guardian (“Client” or “Parent/Guardian”), collectively referred to as the “Parties.”
Client (and Parent/Guardian, if applicable) acknowledges and agrees to the terms and conditions outlined herein for participation in GameTime Nutrition’s remote nutrition coaching program and related services.
1. TERM OF AGREEMENT
Client agrees to a 12-month Remote Nutrition Coaching Program with GameTime Nutrition. The term begins upon the date of payment and continues for twelve (12) consecutive months.
All payments are due as scheduled according to the selected plan. Client understands and agrees this is a binding 12-month financial commitment. Early termination, cancellation, non-participation, inactivity, or discontinuation does not cancel, pause, or relieve Client of payment obligations. All remaining installments must be paid in full regardless of participation status.
2. NO REFUND POLICY
Client acknowledges and agrees that all payments made to GameTime Nutrition are final, non-refundable, and non-transferable, regardless of any personal, health-related, schedule-related, relocation-related, or result-related circumstances, including but not limited to illness, injury, dissatisfaction with results, lack of participation, failure to follow the program, travel, relocation, or early withdrawal.
Any refund request, chargeback, payment dispute, or reversal initiated through a bank, credit card provider, financing company, or payment processor shall be considered a material breach of this Agreement and may result in immediate termination or suspension of access to coaching, messaging, documents, resources, and all related services, while leaving Client fully responsible for any unpaid balance.
3. DESCRIPTION OF SERVICES
Nutrition coaching is delivered remotely through digital and online platforms and may include, but is not limited to: nutrition guidance, calorie and macronutrient recommendations, meal structure guidance, body composition support, check-ins, habit coaching, accountability, educational resources, messaging support, progress review, supplement education, training-related guidance, lifestyle recommendations, and related wellness or performance support.
Services may be delivered through Coach Catalyst, email, video calls, shared documents, and other digital systems used by GameTime Nutrition.
GameTime Nutrition provides professional guidance, structure, accountability, and support, but does not guarantee specific results, including but not limited to weight gain, weight loss, fat loss, muscle gain, improved body composition, improved performance, improved energy, or any other physical or health-related outcome. Outcomes depend on Client’s consistency, effort, adherence, communication, recovery, and compliance with coaching recommendations.
4. NO MEDICAL, DIETETIC, OR MENTAL HEALTH SERVICES
Client understands that GameTime Nutrition does not provide medical care, licensed dietetics services, medical nutrition therapy, nursing care, physical therapy, chiropractic care, mental health treatment, psychological counseling, diagnosis, treatment, cure, or prevention of any disease, illness, or medical condition.
All coaching, education, meal guidance, supplement discussions, and training-related recommendations are provided for general wellness, fitness, performance, accountability, body composition, habit-building, and educational purposes only.
Nothing provided by GameTime Nutrition is intended to replace medical advice, diagnosis, treatment, or care from a physician, licensed dietitian, psychiatrist, psychologist, therapist, or any other licensed healthcare provider.
Client agrees to consult a qualified healthcare professional before making decisions related to any medical condition, diagnosis, medication, eating disorder history, allergy, intolerance, hormonal issue, digestive condition, pregnancy, postpartum status, or other health concern.
5. MEAL PLAN, NUTRITION, AND FOOD CHOICE DISCLAIMER
Client understands that any meal plans, sample menus, food lists, portion suggestions, grocery suggestions, calorie targets, macronutrient targets, meal timing recommendations, or other nutrition structures provided by GameTime Nutrition are educational tools only, designed to support general coaching goals, convenience, adherence, performance, and behavior change.
Client remains solely responsible for all food selections, food preparation, storage, allergies, sensitivities, intolerances, religious restrictions, cultural preferences, and any consequences arising from implementation of nutrition recommendations.
Client further understands that GameTime Nutrition is not responsible for monitoring for allergic reactions, nutrient deficiencies, medical contraindications, or other health complications resulting from Client’s implementation of any nutrition recommendation.
6. SUPPLEMENT GUIDANCE DISCLAIMER
Client understands that any discussion of vitamins, minerals, protein powders, creatine, pre-workouts, electrolytes, herbal products, meal replacement products, or any other supplement is provided for general educational purposes only.
GameTime Nutrition does not manufacture supplements and does not guarantee the quality, purity, safety, legality, effectiveness, or suitability of any supplement for any individual. GameTime Nutrition does not guarantee that any supplement will produce a specific result.
Client is solely responsible for reviewing product labels, ingredients, third-party certifications, medication interactions, contraindications, allergies, banned substance risks, and suitability before using any supplement. Client agrees to consult a qualified healthcare professional before beginning any supplement.
7. TRAINING AND PHYSICAL ACTIVITY DISCLAIMER
Client understands that any workout suggestions, training guidance, cardio recommendations, recovery suggestions, mobility suggestions, step goals, or other exercise-related recommendations are provided for general fitness and performance purposes only.
Participation in training, exercise, cardio, physical activity, or recovery practices carries inherent risks, including but not limited to soreness, strain, sprain, aggravation of existing conditions, illness, and serious injury.
Client affirms that they are medically and physically able to participate in physical activity and assumes full responsibility for all training decisions and outcomes. Client agrees to stop any activity immediately and seek medical attention if they experience pain, dizziness, fainting, shortness of breath, chest pain, illness, or any other concerning symptom.
8. CLIENT HEALTH DISCLOSURE AND RESPONSIBILITY
Client affirms that they are physically and mentally able to participate in a remote nutrition coaching program.
Client agrees to disclose to GameTime Nutrition any known medical condition, injury, medication use, supplement use, allergy, food intolerance, pregnancy, postpartum status, history of disordered eating, diagnosed eating disorder, hormonal condition, digestive condition, physician-imposed restriction, or other relevant health issue that may affect participation.
Client understands that failure to disclose relevant health information may increase risk and may limit the appropriateness of coaching recommendations. Client accepts full responsibility for communicating relevant changes in health status throughout the coaching relationship.
9. ASSUMPTION OF RISK
Client (and Parent/Guardian) understands that participation in nutrition coaching, dietary changes, supplementation discussions, exercise-related recommendations, body composition protocols, and lifestyle changes involves inherent risks, including but not limited to digestive issues, allergic reactions, emotional stress, changes in appetite, changes in energy, injury associated with exercise, aggravation of known or unknown conditions, and other known or unknown health outcomes.
By participating, Client voluntarily assumes all risks, known and unknown, associated with participation in the program and accepts full responsibility for any injury, illness, condition, loss, damage, or adverse outcome that may occur during or as a result of participation.
Client has been advised to obtain approval from a qualified physician or licensed healthcare provider prior to beginning any nutrition, exercise, supplementation, or wellness-related program.
10. RELEASE OF LIABILITY
In consideration for participation in the program, Client (and Parent/Guardian) waives, releases, and discharges GameTime Nutrition LLC, its owners, officers, employees, contractors, coaches, agents, representatives, and affiliates from any and all claims, demands, causes of action, damages, liabilities, losses, costs, or expenses arising out of or related to participation in the program, including those based on ordinary negligence, to the fullest extent permitted by law.
11. INDEMNIFICATION
Client (and Parent/Guardian) agrees to indemnify, defend, and hold harmless GameTime Nutrition LLC and its owners, officers, employees, contractors, coaches, agents, representatives, and affiliates from and against any and all claims, damages, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to Client’s participation in the program, breach of this Agreement, nondisclosure of relevant health information, or misuse of the services or materials provided.
12. NO EMERGENCY SERVICES
Client understands that GameTime Nutrition does not provide emergency services and does not monitor communications for urgent, crisis, or emergency situations.
Client agrees that if they believe they are experiencing a medical or mental health emergency, they will immediately contact 911, local emergency services, or an appropriate licensed healthcare provider rather than relying on communication with GameTime Nutrition.
13. COMMUNICATION POLICY
Client acknowledges and agrees to the following communication standards and boundaries, which are part of this Agreement:
13.1 Approved Communication Channels
The primary communication channel is Coach Catalyst in-app messaging (DMs).
The secondary communication channel is email.
No coaching will be provided through social media direct messages, personal text messages, or phone calls unless pre-scheduled and expressly included for an Elite client.
13.2 Office Hours and Response Times
GameTime Nutrition office hours are Monday through Friday, 9:00 a.m. to 5:00 p.m., coach’s local time.
Standard response time is within 48 hours, although responses may often be faster.
Weekends and holidays are monitored for urgent issues only. Non-urgent replies may roll to the next business day.
Client understands that communication is subject to reasonable use and that the coaching relationship is designed around quality communication, not unlimited access. In general, Client should expect approximately 2–3 touchpoints per weekthrough DMs, check-in feedback, or coaching comments.
13.3 Weekly Check-Ins
Client agrees that weekly check-ins are a required part of the program.
Check-ins are due once per week on Client’s assigned day through the Coach Catalyst Check-In form.
Client agrees to submit accurate and complete information, which may include body weight, measurements, progress photos, adherence percentage, biofeedback, sleep, stress, digestion, wins, barriers, and questions.
GameTime Nutrition will generally provide check-in feedback within one (1) business day, and plan adjustments, if needed, within one (1) to two (2) business days.
Missed check-ins may result in reduced coaching effectiveness. A first missed check-in may receive a reminder. A second missed check-in may require a reset call or further review of program fit and compliance.
13.4 Plan Changes and Turnaround
Macro or nutrition plan changes are generally reviewed every two weeks by Sunday.
Out-of-cycle changes are reserved for issues such as injury, medical updates, or travel.
Meal plan update requests are generally completed within one (1) to two (2) business days.
13.5 Communication Boundaries
Client agrees to keep communication organized and efficient.
Client should use a single message thread per topic where possible.
Voice notes, if permitted, should be limited to two (2) minutes maximum and should clearly state the main points.
Messages may be sent after hours, but replies will occur during the next business window.
Client understands that day-to-day scale fluctuations are normal and agrees that coaching decisions will be based on weekly and monthly trends, not panic-based reactions to isolated data points.
13.6 Emergencies and Medical Changes
GameTime Nutrition does not provide emergency or medical care.
If urgent, Client must contact a physician, emergency services, or another appropriate licensed healthcare provider immediately.
Client agrees to notify GameTime Nutrition afterward regarding any relevant changes in medications, diagnoses, injuries, restrictions, or health status.
13.7 Travel, Vacations, and Blackout Dates
Client agrees to provide at least seven (7) days’ notice before travel, vacations, or events that may affect adherence, communication, or check-ins.
GameTime Nutrition may provide a travel protocol or modified expectations at its discretion.
Check-ins remain due unless a written pause or written alternative arrangement is expressly approved.
Coach vacations or holidays may be announced in advance, and GameTime Nutrition may provide adjusted turnaround times or coverage where available.
13.8 Payments and Delinquency Impact on Communication
If a payment fails, is declined, becomes delinquent, or is disputed, GameTime Nutrition may immediately pause program access, messaging access, check-in review, plan updates, and related services until the account is brought current.
Client remains responsible for all payments due under this Agreement.
13.9 Calls, Reschedules, and No-Shows
For scheduled calls, Client must provide at least 24 hours’ notice to reschedule.
Late cancellations or no-shows may be forfeited.
Program pauses are not permitted unless medically required and approved in writing by GameTime Nutrition.
13.10 Result Ownership
GameTime Nutrition provides the plan, feedback, accountability, and communication structure.
Client is solely responsible for execution, habit adherence, food logging, data accuracy, and communication of barriers before those barriers negatively affect results.
14. PROGRESS PHOTOS, DATA, AND PRIVACY
Client understands that progress photos, body measurements, check-in data, messages, and related program information may be stored in Coach Catalyst or other systems used by GameTime Nutrition for coaching, tracking, recordkeeping, and service delivery purposes.
Such data will be used for coaching purposes and internal business operations only, unless otherwise authorized in writing by Client.
Client may request deletion or export of data to the extent reasonably available and legally permitted. GameTime Nutrition may retain records as necessary for business, legal, contractual, dispute, or compliance purposes.
15. CONFIDENTIALITY AND INTELLECTUAL PROPERTY
All programs, coaching systems, documents, meal guidance materials, videos, educational resources, check-in systems, templates, frameworks, and other materials provided by GameTime Nutrition are proprietary and remain the sole property of GameTime Nutrition LLC.
Client agrees not to copy, reproduce, distribute, publish, share, sell, license, upload, post, or otherwise disclose any GameTime Nutrition materials without prior written consent.
16. ELECTRONIC DELIVERY, RECORDS, AND ACCESS
Client acknowledges that access to coaching platforms, communication channels, digital materials, and program resources may be granted immediately upon purchase.
Client further acknowledges that GameTime Nutrition may maintain electronic records of onboarding, login access, communications, file delivery, check-ins, call attendance, platform usage, and related activity, and that such records may be used as evidence of delivery, access, participation, and performance in the event of any dispute.
17. GOVERNING LAW AND ARBITRATION AGREEMENT
This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles.
Any dispute arising out of or related to this Agreement or the program shall be resolved exclusively by binding arbitration administered under the Federal Arbitration Act and the applicable consumer arbitration rules before a single arbitrator in Kansas City, Missouri.
No class or representative actions are permitted. All claims must be brought on an individual basis only. To the extent any matter proceeds in court for any reason, the Parties waive trial by jury. The arbitrator’s decision shall be final and binding.
18. ENTIRE AGREEMENT; MODIFICATION; SEVERABILITY
This Agreement constitutes the entire agreement between the Parties regarding Client’s participation in GameTime Nutrition’s remote coaching program and supersedes all prior oral or written understandings related to the subject matter herein.
GameTime Nutrition may update policies, procedures, systems, and operational guidelines from time to time, provided such updates do not materially alter Client’s core financial obligations without written agreement.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. ACKNOWLEDGMENT OF UNDERSTANDING
By signing below, Client (and Parent/Guardian, if applicable) affirms that they have carefully read and fully understand this Remote Nutrition Coaching Waiver and Agreement.
Client acknowledges that they are voluntarily giving up substantial legal rights, including the right to sue, and are doing so freely and knowingly in order to participate in GameTime Nutrition’s Remote Nutrition Coaching Program.
